Nationwide Permit Regional Conditions for Idaho

WorkWalla Walla District 2012 Regional Conditions. Division Engineers are authorized to add regional conditions specific to the needs and /or requirement for a particular regional or state. Regional Conditions are important mechanisms to ensure that impacts to the aquatic resource authorized by the Nationwide Permits are minimal both individually and cumulatively. The Regional Conditions listed in the Special Public Notice were approved by the Division Commander on March 16, 2012 and became effective for the State of Idaho on March 19, 2012.

Publication of the 2012 Nationwide Permits (NWP) in the Federal Register on February 21, 2012 started the 60-day period for states, Indian Tribes and the US Environmental Protection Agency to complete their Section 401 Water Quality Certification (WQC)process for the Nationwide Permits. The 60-day period for WQC will end on April 20, 2012.

During the WQC review process, the use of an NWP to authorize a discharge into a waters of the United States is contingent upon obtaining individual water quality certification or a case specific WQC waiver.

Regional conditions are important mechanisms to ensure that impacts to the aquatic environment authorized by the Nationwide Permits are minimal, both individually and cumulatively. Unless otherwise noted the revised regional conditions listed in the Special Public Notice are applicable for activities authorized when the 2012 Nationwide Permits become effective for the State of Idaho. Comments should be received not later than the comments due date of this notice to receive consideration.
