Appeals Process

The Corps administrative appeal process is outlined in 33 CFR (parts 320, 326, 331) Final Rule Administrative Appeal Process for the Regulatory Program for the Corps of Engineers.  Applicants and landowners may appeal denied permits, issued permits that contain requirements that are unacceptable to the applicant, or jurisdictional determinations that are made by the Walla Walla Corps District office.

The request for an appeal of those decisions mentioned above must be submitted to the Corps' Northwestern Division Appeals office, located in Portland, Oregon.  Request for an appeal must be furnished to the Division office within 60 days of the date of the appealable decision.  A site visit, an appeal conference or a meeting may be conducted during the appeal process.

Status of Appeals:  Northwestern Division

A decision on the merits of the appeal, based on the administrative records, is normally made within 90 days.  The Division will either uphold the District decision or remand back to the District with direction for reconsideration of the initial determination.  After re-evaluation, the District is to make a final decision. The final decision is not subject to further appeal.
